The key issue regarding royalties is the impact on profits of the licensees. To the extent that royalties are paid to SanDisk, SanDisk will find it easier to remain a lowest cost producer. This is a good situation to be in if there should be a glut at some future time, since the licensees would have a more difficult time meeting prices of SanDisk units.

On the other hand, there must be some types of flash memory where no royalties are owed to anyone, in which case competition could be fierce. The high ticket items, however, still seem to have a lot of patent protection. As an example, the SD and miniSD form factors are patented. So are certain controllers.
