The Israelis already tried jailing him, and the result was that it didn't reduce terror attacks against Israel. I believe that this is the true reason for not bothering to arrest him again. It's basically an "ends justifies the means" argument for an illegal killing, but in addition, it not only lacks any assurance of achieving the ends, it has already proved quite hopeless at achieving the ends.

P.S. I can just imagine the fate of all the able-bodied Hamas members, now that they can't get their marching orders from the paralyzed guy. They're probably all standing around saying "now what do we do? With the paralyzed guy gone, how will we know whether or not we should attack Israel or not?" Maybe that's what Sharon thinks this accomplished.

The choice is: try to kill the terrorist leaders, or grant them immunity to plan and implement attacks designed to kill thousands of civilians. There is no operating judiciary in the Gaza strip, so "judicial" anything is not an option.

I thought they invade all the time.


They have been raiding, different in scale and duration. In and out to seize or kill the target. A full scale invasion, staying for days and weeks with thousands of troops, and casualties running into the hundreds (all reported as civilian because Hamas doesn't wear uniforms) is something quite different.
