I think it's more a matter of, by the time the case actually got to court, you'd be out of business. That's the fear that keeps these companies from going public. And it's generally done through nuance and clear hints. Intel doesn't send a signed document that says "if you ship a thin and light notebook with low voltage Athlon XP in it, we'll cut off your access to information." It's done through undocumented conversations at off site locations similar to:

"We've heard from some component suppliers that you're looking into offering an AMD based thin and light. You do understand that we'll have some concerns about releasing advanced engineering data on our products to you if you might use that knowledge to support a competitor's product.... and we've been supply constrained recently, too. We may have to limit some customers access to the components they need for their most profitable skus.... You do understand what I'm telling you, right?

Glad we've cleared up that little problem. So, are you going to have the beef or the fish?"
