Because apparently there is a gap in the law that the US congress has passed with regard to the status of US citizens taking up arms with a supra-national non-state entity.

Normally they would be considered criminals. However, a terrorist organization resides in a very grey area between criminality, treason, and activities as a member of a internationally illegal combatant entity.

Personally, I consider them to be guilty of treason and they should be tried as traitors, stripped of their citizenship and locked away on some distant atoll (or executed).
