By all means, capture those who can be captured. They way you break up a crime ring is to gather information.

Yes, release a missle. The implication is that he is spotted but not in an area likely to lead to capture. OBL is also already under warrent, so there is not the presumption of innocence. The alternatives are not between arresting someone or just leaving them alone. There is also the questioning of people who turn out not to be terrorists.

The real implication of treating the terrorists as criminals is exhibited in the approach taken to those in the terrorist area. They may be terrorists, they may be civilians. The key to success is to make the distinction because if you just start shooting and bombing at random you can be sure that they will all turn out to be terrorists in the end. For all the macho bravado that gets thrown around, it is not really feasable to kill them all.
