I'd honestly like to see TiVo make it. They did much of the early PVR lifting. Gemstar actually didn't lead its IP defense with the Levine time-shifting patent covering VCR-like functions on a hard drive such as Pause, Play, Fast Forward, Rewind, etc. although Henry alluded to it. TiVo undoubtedly has some proprietary art and it could be that EchoStar trespassed on one or more of its claims; I don't know. Ergen might try to engineer-around using Gemstar's technology or battle TiVo in court, or both ... more unknowns. TiVo has more than a few subscribers that swear by the product. Now they have licensed technology from Gemstar which can only improve the product and its chances of survival. Anyway, I agree that it's probably going to get more difficult for them with the CEMs and MSOs moving into the market.
