Yes, I agree. At best it adds to the complexity and thus is a productivity drain. The really sad thing is that Congress sometimes writes laws with holes on purpose because they can't reach agreement and want the courts to sort it out. The ADA is the classic example of this.

it all leads into the subject of TORT and general legal reform.

I'm all for that.
