The only error I see in that is that Germany DID declare war on the US on December 11, 1941. The US Congress replied with a declaration of war on Germany. It is customary to consider that if a nation declares war on another nation, they are at war whether any attack at all has occurred. This was fairly much the case during the "Phony War" between France and Germany in 1940. Hardly a shot was fired between them.
