Karen, the pictures show three different bulldozers. Clearly, Rachel did not learn from her encounter with the first, flirted with disaster with the second, and caused disaster with the third. Your brother-in-law also knows that it is difficult, not impossible, to see what is directly in front of a bulldozer you are operating. Your arguments would hold water if the bulldozer operator was convicted of murder. Was he?

It matters little what the driver saw or didn't see. She was a hero to herself and her friends for stalling the job. She is a dead hero to them now.

What gives a person the idea they have the right to interfere without consequence?

She knew the consequences of her actions and should be at peace with the result.

Perhaps you believe idiots like that young woman should be able to control what anyone does without consequence, merely by putting herself in harms way.

The young lady discovered she doesn't control the world.
