Of course Israel can make a case against Hamas. Hamas has sent hundreds of suicide bombers into Israel. It's not like Hamas hides their program, any more that OBL does. But their leadership does hide (Yassin and Rantisi were hiding), just like OBL is hiding, in places not subject to the jurisdiction of Israel.

What part of the word "jurisdiction" is unfamiliar to you? It refers to places where the army and the police are NOT your army and police, and if you want to lay hands on somebody, you need to mount a military invasion or intervention to do it. That is the relationship of the US to the tribal areas of Afghanistan, and it is the relationship of Israel to Gaza City. Your blithe negations notwithstanding, THOSE ARE THE FACTS.

By the way, how does one become leader of Hamas?

By appointment from the head of Hamas, safely residing in Damascus. These are not democratic institutions, you know.
