You're missing the fact that Kerry was following orders.

Not so fast Bucko.

This is what the Uniform Code of Military Justice says:

892. ART. 92. FAILURE TO OBEY ORDER OR REGULATION

Any person subject to this chapter who--

(1) violates or fails to obey any lawful general order or regulation;

(2) having knowledge of any other lawful order issued by any member of the armed forces, which it is his duty to obey, fails to obey the order; or

(3) is derelict in the performance of his duties; shall be punished as a court-martial may direct.

The key here, dear Orca, is "lawful order."

Military personnel are obligated to follow lawful orders, but they are also duty bound to disobey "unlawful orders."

So don't give me "Kerry was following orders."

I thought the Nuremberg trials eliminated that as a defense.

Obviously you've never been in the military. There is a little thing called a lawful order. I would find you the link to the UCMJ but I know it wouldn't make any difference in your made up mind so I won't waste the time.

Edit: I see Smithee already did.
