Yes, if he were tried for the same offence or a less included offence.

"Lesser included" means that if he were tried for first degree murder, he could not be tried again for second degree murder, and so forth.

He could still be charged with other crimes which were not lesser included crimes, but unless the distinctions are very clear (e.g., rape and robbery have nothing in common) it's hard to say how it would come out.
