Horsehockey. If that was applicable in this instance than MSN could be prosecuted. You should know that with the Pentagon Papers which were classified. The Washington Post was allowed by their first amendments rights to publish the content within. It was resolved in Court. An uncleared person has the same Constitutional right to free speech as any other person. Ellsburg could have been prosecuted but the government chose not to.

What allows cleared persons to be prosecuted for releasing classified information in an unauthorized manner is the agreement[s] they sign at the time they receive their clearance. Those agreements relinquish their right to free speech with classified documents.

That's BS.. Those photos don't have to be marked. The media they are contained on (CD disks) would have to be labeled with their classification. To NOT do so is a security violation in itself worthy of investigation.

If the media is a CD, the CD is labelled and the individual files are to be labelled regarging their classification.

Furthermore, it's theft of government property, which I believe is also up to 10 years.

It is not my understanding that the photos were taken with a government camera. Eveything I've read indicates they were taken by personal cameras.

But one thing you cannot avoid acknowledging with any credibility, is the fact that THE ENTIRE TAGUBA REPORT IS CLASSIFIED AT THE LEVEL OF THE HIGHEST CLASSIFIED PORTION, in this case Secret/NoForn.

I could care less about the "U" portions.. They are STILL CONTAINED IN A CLASSIFIED REPORT and THEY CANNOT BE DISTRIBUTED WITHOUT BEING OFFICIALLY DECLASSIFIED.


That is absolutely false. Any paragraph within the Tabuga report that is marked {U} is unclassified. Those paragraphs can be extracted and published.

You can question the merit of having classified those photos.. But you cannot deny that they were part of the full report, and thus, were classified at the level of the entire report.

Each paragraph is to be classified individually. Each photo is to be classified individually. Those are basic requirements of classification. The only allowed exception is "working papers" whose individual paragraphs do not require classification. "Working papers" are not final or even draft reports. "Working papers" was a rough designation to allow for people to take classified notes.

My only regret is that I wish you represented a real flock of ducks..
