Yeah, you guys are right that there will be evasion of the taxes.

The reason indoor grow operations are profitable is that the price of pot is artificially high because of enforcement against it. Growing outdoors is obviously far cheaper, but, if taxes add enough to the price, indoor tax-evading grow operations will have a similar payback.

As for treating tobacco and marijuana the same, well, I think we already covered that ground. They are not the same. Marijuana is far more psychoactive and creates driving risks, etc. while tobacco is largely a long-term health risk. Marijuana would have to be regulated like alcohol, while tobacco would be regulated like DDT.
