In many gangs, (even some fraternaties) the members are obliged to commit secret crimes, known only to other members. These become both a bond and a source of blackmail to keep the gang members loyalty.

The old guard of neocons, those who had participated in Iran Contra, may not have been giving all of the options in their advice. They may have emphasised options which would secretly break the law. Memos such as this would make it clear to even the slowest of participants that they are all in it together.
