Kenneth Lay on the other hand should do some hard time...the trial is just getting started.


The judge has very little discretion in sentencing. It's a grid, and you plug in the offense level, the monetary loss, criminal history and other factors like complexity of the scheme and whether the defendant has accepted responsibility.

Out of that you get a sentencing range. Her range requires at least some incarceration.

As for Ken Lay, throw the book at the guy. He and the other Enron folks shouldn't see light of day again.
