If we are already at the point where The Bill of Rights is not applicable to very American, we are much deeper shit than I thought.

Including Padilla and Hamdi, and any other Americans being held as "enemy combatants" in conditions which violate generations of clear legal precedent. I agree.

As for Boykin -- he has a First Amendment right to free speech, but when he is on the job, he is a public servant of the American people. ALL the American people. Your employer has the right to control the time, place and manner of your speech when you are on the job.

Off the clock, is a different matter.
