If you include indirect effects then you can't have any government if you are to follow that amendment. I'm not sure you could have taxes, you also wouldn't be able to have fines, imprisonment, or execution as punishment, and perhaps not even such things as suspending drivers licenses.

Also I was looking more for a way to realistically deal with this specific situation and other like it, rather then a massive general move to a minarchist government. Not that I'm really against such a move but its a little outside the current situation. If it was possible to pass such an amendment I doubt we would be having problems with things like ladies night. Any electorate that would elect people that would vote for such an amendment would already be voting for minimal government.
