This raises a very scary issue thats somewhat unrelated to torture in Iraq. That memo lays out that constitutionally the legal analysts believe the President in time of war has absolute power with no checks or balances. I can't think of ANYTHING more dangerous than this idea. There are those who actually WANT their leader whoever that person is, someday to do exactly that. And what are the checks and balances on such an abuse if a runaway President has the support of the military? The only check left is state militias that do not exist except in an unorganized form. And the likes of Feinstein, Shumer, Boxer and all diligently working to stop the LAST FINAL potential power check.
