Good question. I don't seriously know the answer. I assume the presidential right to pardon is built into some statutes somewhere.

But I do know that both Watergate and the Iran-Contra scandals were about precisely this issue. Moreover, it seems to me that once the notion of presidency above law were to take hold, democracy itself would be in danger. I'm not arguing we have that here. But it does seem to me the Bush administration ventured onto that slope. Just how slippery it is, we'll see.
