Parts of it have been floating around since the Clinton administration tried twice to get many of it's provisions enacted....

On-the-other-hand, the Act that was passed was DEFINITELY already on the shelf somewhere within the Bush administration, just waiting for an opportune moment to slip it into the Congressional machinery for passage, when 9-11 came along and gave them the perfect chance to rush it through without examination.

So, maybe it is more fair to say that Authoritarian elements in our Intelligence and Police Services have wanted these expanded powers for a very long time --- regardless of administration.
