I understand the final ruling pretty much. My point has always been, how did it even get there? I may be seeing something from your posts that I have not realized. But still at this point think the USSC was well within bounds to step in and do what was right.

I have never understood why it was allowed to proceed because I thought that the conditions Bush argued about the machine malfunction, fraud, etc., were necesary to get the manual recount. Where do those provisions come in?

I think I now know (thanks to Mr. Palau) why it was able to start. Gore did not need to show these conditions to do the selective manual recount. Correct?

If so, what statute to did Bush folks argue against Boise? Seems like that angle would never have been attempted if no conditions for the manual recount were required.

I appreciate your feedback in this exchange, and hope that you can add to my understanding of the issue.
