I recall the contemporaneous discussion of this. There were those expressing a need for some independent oversight, if not the courts than some board or other, to review appeals of detainee classifications. That seemed pretty basic to me. There was also a lot of hoo-hah at the time, though, about the classifications that the administration came up with so maybe that's why they were so stubborn about it.

I've noticed some commentary that's equating this decision with that whole business of terrorism as a crime or a military paradigm. I haven't read the decision--and don't plan to--but, unless I'm missing something, those folks are hyperventilating.

I thought the Court did a decent job today. My opinion may change as I read some more.

I think you have a good point that the reaction is more political score-keeping than anything.
