If the man drops what is in his hand and puts his hands on his head, there will be no problem. If he continues to act as if he has a weapon, as Saddam did, then he will go down.

How did Saddam act like he had a weapon? He said he didn't have one, he let the inspectors back in with no restrictions on inspection sites, and he wasn't threatening anyone with anything. I suspect that your concept of "threat" and the level of threat that's required before deadly force is justified under either international standards or police standards, are far different.
