Here's something I have long wondered about:

Why were the Alien and Sedition Acts not ruled unconstitutional by a federal court, or by the United States Supreme Court?

The reason: Chief justice John Marshall had not yet enunciated the concept of judicial review.

That came in 1803 in Marbury v. Madison. No provision for judicial review had been put in the Constitution by the founding fathers.
