Hmmm....maybe the charge was too severe, but IMO in this era of national worry about possible terrorist threats, wearing a ski mask anywhere doesn't make sense. Probably most people didn't think this was funny, and I'm sure the store owner thought he was being robbed.

"Pranks" in an era of terrorist threats really aren't funny. Obviously those in law enforcement felt the same way. Walking around with a ski mask while talking on a cell phone would make many people wary, and I'm sure that some would associate his behavior as extreme and suspicious.

There was a radio personality in the Bay Area a few years ago who stopped traffic on the Bay Bridge as a "prank". I believe that was prior to 9/11, and the charges against him as well as the radio station were severe. (Most people didn't appreciate his humor.) Since 9/11, I'm sure similar charges would most likely have been filed if he were to attempt that "prank" again.

He didn't go far enough. If he had worn a parka and ski boots, they would not have charged him.
