disallowing naked shorting but allowing longing on margin is biasing the market. they should either both be allowed or neither be allowed. apart from that, naked shorting is perfectly legal in many parts of the market via all sorts of derivatives - and it doesn't hurt the market because naked shorting healthy companies is a recipe for financial ruin of the shorter.
