No, that's a legal scholars opinion. The scholarly opinions vary from this was the US Supreme Courts darkest moment, to "what else could they do?".

But almost everyone agrees it was a pragmatic, not a legal decision. That there was little or no legal justifaction for the US Supreme Court to even be involved.

Take that anyway you want... the conversation is getting old. But "duly elected" is certainly a stretch.

Bush is the least "duly elected" President in American history. By anyone's measurement.
