This is the same woman who couldn't say enough bad things about the administration's recent Hispanic candidate for the Appellate bench. Divisive? Yes, I would say so. She needs to look in the mirror.

No. She's simply saying, best I can tell, that it has no chance of passing the senate--some estimates are as few as 40 senators will vote for it and it requires 67--so why bother. It's clearly meant for campaigning purposes.

My quarrel with Feinstein's position is that this happens all the time in election years. If I were her, I would vote against it and talk about other things.

The whole issue at hand is that it isn't being allowed to be left to the states. It is being decided by the courts, in spite of the legislatures. What happens when a gay couple married in Mass. goes back to Wyoming (for example) and sues for recognition of the license? It is not guaranteed that the court would rule on the side of the will of the people of the state of Wyoming, via the legislature. If that were not the concern, a Constitutional Amendment would be moot.
