If you're referring to Katherine Harris, then-Florida Secretary of State, you already asked that question elsewhere and I already answered it.

The Florida Secretary of State's job was ministerial, not discretionary. She followed the rules like following the recipe to bake a cake. Therefore, it isn't as if judgments need to be made and discretion exercised.

Besides, Florida did take appropriate action -- THEY ELECTED HARRIS TO CONGRESS, DUMMY!!! lol
