"Or what about the death-penalty?"

How about abortion? I think that how seriously someone takes an issue to be, weighted against the states's rights will decide whether they want national law involved. Bush is a states right guy too, but after the Mass supreme court wrote new law, he sees no other way to protect marriage.

Dems have a tendency to throw out the state's rights argument whenever it suits them.

"the Defense of Marriage Act will be decided by the US Supreme Court not in Mass, so what makes you think it won't stand up?"

My opinion is that it will not. I'm not a lawyer, so don't claim to be an expert. What do you think? Think it will stand? Seems like the equal protection clause may have some bearing (because the married gay people would have more "rights"). But again, I am not a lawyer. Give me your honest opinion in one word (yes or no) as to whether you think it will hold up. Remember, honest opinion. Maybe we can make a bet. It certainly won't hold up if a dem gets to start picking justices.

"But the majority, in many polls, oppose Bush's amendment."

I think his support of the overriding principal of strongly supporting traditional marriage may help. Many do not know what specifically happened in the Senate today. And your "many polls" comment is kind of interesting. Either a majority oppose the ammendment or a minority does. My guess is that a majority would support one. Feel free to post one of these "many polls".
