It doesn't matter what the justice system looks like- if you can stand outside society and look at humans in general. The one we have is fine, in its arbitrary way- the British system is fine also. Social contract, it's what we get if there is a contract- you can't get much more relative than that. Whatever the collective agrees on, is what you get. You can jump up and down and say you have rights the collective does not grant you, but it won't get you very far. And if the collective is lazy, we get a despot. Human history. Those with the power make the rules, and whether the power is in the hands of few or many, no difference to the rule making enforcement function- it just matters in terms of whose interests are represented.
