It's not a likely way to succeed, however it is the only way to succeed. The only other way would be to get rid of all activist judges. At least all of the higher up ones.

I'd love that solution, but that is even more difficult / impossible.

Congress makes law, judge interprets law. When said judge makes his own law things get muddled. A constitutional ammendment is the most direct and least messy way to get the job done. Most direct, and least messy says nothing about chances of success though.
