The difference is quite simple. Intentional targeting of civilians is a crime. Accidental killing of civilians who may or may not be combatants or maybe even family and friends of combatants who are in the wrong place at the wrong time fall under the category of collateral damage and not war crimes. In Iraq we've seen SH put troops in schools, hospitals and mosques. The insurgents have regularly fired from mosques and cemeteries. The insurgents blend in with the civilian population, stay in civilian homes etc. They are legimitate targets no matter where they happen to go.
