Far less than 20% of cases filed ever get to that stage, and even less of potential cases. So if you get to the point that the lawyers are butting heads, you've got at least colorable contested issues.

The winnowing process is constantly separating the wheat from the chaff.


Following out that logic, by the time a case reaches the Supreme Court, perhaps a coin flip should be used to decide the case. Less biased than people. Of course, coins can't write legal opinions, so you would still need a judge for that.
