Neocon, I would define an atrocity as the abuse or killing of anyone when CLEARLY aware that the person they were killing or abusing was not a present threat, or was not an enemy soldier or, if they were, that they had surrendered and were no longer a threat.

Under my definition, in order for the atrocity to occur the soldier would have to KNOW that there no threat. An unreasonable but honest belief that action was necessary would be a sufficient justification to avoid punishment, although that person might not be the best person to keep in combat.
