true, but in this case, there is a concert format and there is a well-defined expectation of the product to be delivered. therefore there is an implicit contract with the performer that accompanies the ticket purchase.

btw, "gratify" means that they got what they came for... therefore, much depends on how expectations are set. also, I do believe that some of the issue lies in the distinction between artist and entertainer.
