Let's put it this way:

If one were to cross-post a message to two threads, and then post link(s) to one or both of those posts to other threads as a means of propagating the original message(s), that would definitely be spam. Intent, not means, is the real issue.

That said, it's the abuses that run afoul of the TOU. For example, frequently cross-posting to 3 or more threads, posting off-topic, pumping a penny stock, etc. Someone who occasionally cross-posts to three threads isn't necessarily tempting fate, unless there's something else that makes them worthy of scrutiny.

Is that sufficiently ambiguous and plausibly deniable? <g>
