Ah but we do lock up criminals before actual violence is committed. Take for example firearms. The laws makes a presumption of aggressive intent for example, for failing to register firearms according to law. That can be a felony and could be used against Grandma who is hooked up to an oxygen tent but has a pistol from her deceased husband in the closet.
