I am having a hard time figuring out who would have a cause of action against CBS. Bush doesn't, he comes under NYTimes vs. Sullivan, they can say pretty much what they want unless they know the content is false. Regardless, Bush isn't going to sue them. They know that. He's no dummy. Nobody at that level ever sues over nasty criticism. I suppose Killian's wife could sue, but she'd probably go out on summary judgment, the report wasn't directed at him. His reputation wasn't seriously damaged, either. No harm, no foul, vis-a-vis Killian, is my guess. So where does that leave us? Dirty tricks, and that's politics. It will turn off the swing voters is about it.
