That's intersting... but couldn't chance it here... The pedestrian is almost always right...

No worries in New Zealand. The worst you get is a criminal conviction for careless driving causing death, or if obviously deliberate, or if the driver is also drunk, manslaughter which would involve a gaol term of maybe a couple or four years, plus loss of driving licence for some time.

There's no being sued for damages. Accident Compensation Corporation takes care of any payouts and the lawyers have to find another way of extorting money from people.

While visiting the USA, I was fascinated how motorists would stop way back from me when I was walking across a car-park. I didn't realize what was going on at first, then realized they do NOT want to be sued for even making a pedestrian nervous and stumbling or something.

Depends on where you live, it may not cost much. My cousin in LA went to airport to see someone off, and hit by a car which was backing out (the driver did not look backward at all), and one of his leg got fracture. So my cousin took him to the court since he had no insurance. And after 12 months of ordeal, my cousin got $6000 but 60% or so belongs to the lawyer, so the leftover did NOT even cover his medical bill (he had no job at that time)
