"Not illegal" is a separate inquiry from whether
the pre-nup was "unconscionable."

The "unconscionability" analysis concerns whether it
will be upheld; i.e. whether it essentially passed the
"smell test." This is somewhat different from whether it
is theoretically legal in the first instance to even
have such a contract.

Did you see that stupid recent movie with George
Clooney and whats-her-name, which concerned pre-nups?
It was dumb as heck but funny about the prenups, as though
anyone would be entitled to 50% of the principal of
separate property after an overnight marriage......lol
