Conservatives, and by this I mean Federalist Society types, believe that the amendments abolishing slavery should not have been necessary. Slavery could have been abolished on a state level, as many states did, or by federal law, as it was when various states were admitted to the Union.

But that's a legal argument, factually it took a war and a Constitutional amendment to abolish slavery.

Legally, Bush was right.
