Actually it probably was. Roe v. Wade is the easiest to comprehend example of overweening judicial activism in our lifetimes. The founders never dreamed that any future Supreme Court would believe it had the right to decide, not just the legality of abortion, but when and how states could regulate abortions depending on the gestational stage of a fetus.
