There are 40,000 lawyers out there milling around poll sites having their briefs in hand

There's word out today that Kerry and his cadre of lawyers are preparing for a legal coup in states where they might have a snowballs chance of overturning the ballot count. In this case, Kerry will not make a concession speech on election night and will presume himself to be rightfully elected which will further fuel his troops to hurl more rhetoric. They will spend possibly weeks fighting multiple court battles to try to push any legal challenge that these ambulance chasers can come up with.

That could spell additional trouble for the stock market in a post-election atmosphere of uncertainty. Now look beyond October for a November dip in the market if this scenario plays out.

Of course, this all goes away if the polls are wrong and there is a clear-cut winner in the election.
