Punitive damages are by definition over and above the damages, that is over and above the amount deserved. They are designed to punish the party who caused the damage and deter future damages.

Heavy and overly used punitive damages encourage lawyers to file unnecessary lawsuits in hopes of making "killings" and drive up the cost of doing business (like providing health care, for example).
