California Authorities Subpoenas Flu Shot Distributors Amid Gouging Reports During Shortage

SACRAMENTO, Calif. (AP) -- California authorities subpoenaed three flu vaccine distributors Friday as part of an investigation into whether medical supply companies are taking advantage of the supply shortage.

Attorney General Bill Lockyer is seeking documents relating to the sale, offer for sale or advertisements for the flu vaccine from three Southern California companies -- Dubin Medical Inc. of San Diego, Nationwide Medical Surgical Inc. of Van Nuys, and Advanced Medical Sales, Inc. of Laguna Hills.

No complaints of high-priced sales have been received, Lockyer said, but his office has heard of several offers for the hard-to-find vaccines.

Even those offers could be prosecuted, he said.

"My message to those thinking about exploiting this crisis to rip off health care providers and vulnerable consumers is this: You're not going to get away with it in California," Lockyer said.

Messages left at the companies' offices were not immediately returned.

Flu vaccine was left in short supply after one of the nation's two flu vaccine suppliers couldn't ship an estimated 48 million doses because of contamination at its factory in Liverpool, England.

Chiron Corp.'s manufacturing troubles left the country with an estimated 55 million doses manufactured by vaccine maker Sanofi-Aventis. The company has agreed to direct more than 22 million additional doses to people most at risk.
