I believe I read a study by the Heritage foundation which put the figure closer to 20%. And that was a number of years ago. No doubt the cost is continuing to rise, especially, when you factor in the cost to society of having less and less doctors go into the business of delivering babies.

Since the cost to have children is rising, could a corollary affect on our society be we move in the direction of Europe and have less and less children, which in turn affects how much we are able to provide to our elderly in the way of care?

As I said, there are far too many unknown and unknowables for someone to come to a reasonable conclusion, and the figures are going to be dependent on the the assumptions and biases brought to the table.

The simple fact is, litigation is costing our society a tremendous amount of money and resources, and is slowing decaying our quality of life. One Presidential candidate is willing to take on the powerful lawyer lobby group, and one candidate is in its hip pocket.
