Then let me clarify. Martha should absolutely positively not be serving any time.

The prime test of a law is what would an average person do in the situation described (often worded as "reasonable man"). So tell me, if you are holding a stock and the CEO of the company tells you that it is going to dive, are you not going to sell it? Do you really think the average person will hold on to a losing stock?

On the other hand, I don't have any problems with prosecuting the guilty CEO for passing the information to his buddies and breaking the fair disclosure laws.

Assign blame where it is due.
