Good points. For the true "Mongolian C- F-" you need a tied election, plus sufficient election screwups to leave piles of dubious counted and/or dubious uncounted votes lying around, which if thrown out/counted would change the result of the election. Florida had those aplenty. The contrary case was the Washington Senate race of 2000, which was also a dead tie, but was suffiently well run so that there were no pile of votes lying around for the lawyers to fasten upon. So they did a count and a recount, and that was it.

I thought that the "third person" proposal was kind of silly. But I share Friedman's concern that an avalanche of legal challenges may create a systemic crisis. And it does look like both sides are prepared to do it.
